(A consumer is any natural person who concludes a legal transaction that cannot predominantly be attributed to their commercial or self-employed professional activity.)

Information on the right of withdrawal

Right of withdrawal
You have the right to withdraw from this contract within 30 days without giving any reason.

The withdrawal period is 30 days from the date:

• on which you, or a third party designated by you (who is not the carrier), have taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered together;

• on which you, or a third party designated by you (who is not the carrier), have taken possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract. This can be done via e-mail: support@timberlyn-toronto.com.

You may use the attached model withdrawal form for this purpose, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send the notification of your exercise of the right of withdrawal before the withdrawal period has expired.

Conditions for returns
In addition to the statutory right of withdrawal described above, the following conditions apply to returns:

• You may only register an item for return after you have physically received it.

• Return shipping costs are entirely the responsibility of the customer, including any international shipping costs.

• Items must be unused, unwashed, undamaged and in their original condition, with all labels and tags still attached.

• Trying on is allowed, but wearing the item is not.

• Returning products that have deliberately been ordered in multiple sizes with the intention to (partially) return them is not permitted.

Consequences of withdrawal
If you withdraw from this contract, we will reimburse all payments that we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within 30 days from the day on which we receive your notice of withdrawal.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise. In no case will you be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have either:

• received the returned goods, or

• you have provided proof that you have sent back the goods,

whichever is the earlier.

You must send back or hand over the goods to us without undue delay and in any event no later than 30 days from the day on which you informed us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of 30 days has expired.

The direct costs of returning the goods are for your account.

You are only liable for any diminished value of the goods if this loss in value is due to handling of the goods which was not necessary to establish the nature, characteristics and functioning of the goods.

Liability

• We are not responsible for lost parcels if the tracking shows that the item was delivered to the address provided by the customer.

• If an incorrect address has been provided, this is the responsibility of the customer.

• Errors in the address must be reported within 24 hours after placing the order.

Reasons for exclusion and expiry of the right of withdrawal
The right of withdrawal does not apply to contracts:

• for the supply of goods that are not prefabricated and for the production of which an individual choice or decision by the consumer is decisive;

• for the supply of goods that can spoil quickly or have a limited shelf life;

• for the supply of alcoholic beverages, the price of which was agreed upon at the time of the conclusion of the contract, but which can only be delivered after 30 days and whose actual value depends on market fluctuations;

• for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely for contracts:

• for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and whose seal has been removed after delivery;

• for the supply of goods which, after delivery, are inseparably mixed with other goods due to their nature;

• for the supply of audio or video recordings or computer software in a sealed package, if the seal has been removed after delivery.
